Hosting Terms & Conditions
General Information
This document sets forth the Terms and Conditions for Hosting services provided by Trafico (hereinafter “Trafico”) to the purchaser of services (hereinafter “Customer”). By contracting these services, the Customer agrees to be bound by these Terms and Conditions.
For the Customer’s reference, please note the existence of General Terms and Conditions that broadly govern the relationship between Trafico and the Customer, as well as specific Policies that regulate behavior and set limitations within each service. All such documents are available on Trafico’s official website.
Definitions and general information about Trafico are provided in the General Terms and Conditions.
1. Purpose
The purpose of this document is to define the rights and obligations of the Customer and Trafico when contracting Hosting services, including Cloud Hosting on Shared Servers, Cloud Hosting on Virtualized Servers, and Cloud Hosting on Dedicated Servers.
2. Features
All the features of the web hosting plans will be published on the official website and will be valid for the contracted period. If the plan is no longer published on the official website, it cannot be contracted again.
The current prices will be published and will be completed in the Shopping Cart. Digital consent for the purchase will be obtained with a clear and precise acceptance mechanism.
3. Modifications
The hosting plans offered on the official website may change without prior notice and will only need to be published to take effect. In the case of services already contracted, specifications may be modified. The Client will have a period of 15 days from their publication to object and obtain a refund equivalent to the proportional part of the remaining duration of the service.
4. Forbidden Cases of Use
The content that the Client uploads to its hosting service may be audited to obtain usage information, and it reserves the right to deactivate, cancel and suspend the service that is in breach and the User Account in general without the right to compensation.
The purpose of the service is to host websites, so it is prohibited to store content whose purpose is to consume memory, mentioning but not limited to:
Content protected by Copyright or Licenses.
Audio and/or video streaming.
Game Server.
Content distribution sites, backup, shared files or mirror sites and virtual files.
Sites created to redirect traffic to another.
Sites open to the general public or to third parties to share the resources of your plan (whether offered for free or resold).
Sites with Adult Content.
Resell space, as it is for personal use.
In turn, for legal protection purposes, it is prohibited to use the service for the following purposes:
SPAM.
Commission of crimes, including negligent crimes including but not limited to: fraud, extortion, threats, hacking, phishing.
Child pornography and eroticism.
All paraphilias and mental disorders in general, except for cases used for scientific and informational purposes.
Violation of intellectual property rights.
Cyber attacks.
Any file that is hostile, damages the servers of Trafico Cloud Hosting, or any other on the Internet, including but not limited to Trojans, viruses, worms.
Sharing business, content and relationships with countries restricted by the United States of America and the European Union.
Impersonating web browsing identification information, including but not limited to: IP address, location, domain.
Pyramid schemes, including investment schemes.
Shells. Hosting accounts primarily for shell access.
Online pharmacy prohibited in article 226 of the General Health Law.
Entering or intervening in the services of Trafico Cloud Hosting, including servers, official website, payment receivers, firewalls and in general any form of storage and protection that Trafico Cloud Hosting uses to maintain the order of its services.
Any activity regulated by law for which you do not have a permit, including but not limited to raffles, bets, buying and selling of living beings, alcoholic beverages, medicine, medical, aesthetic and professional services.
Trafico Cloud Hosting reserves the right to report any action considered presumably criminal or against the law.
5. Fair Use Policy
Technical limitations and prohibitions will be indicated in the Fair Use Policy. Failure to comply with the requirements of Trafico may result in suspension of service and cancellation of service in cases of repeat offence, without the right to a refund.
6. Availability
Trafico does not guarantee the availability of hosting services, however, in the event of hosting service failures that persist for more than 24 continuous hours, the user will be reimbursed with the refund of the charge made on the affected service calculated proportionally to the duration of the interruption.
It will be the responsibility of the Customer to make backups of its content and will be the sole party responsible for the loss of information stored in its service, thus releasing Trafico from any liability related to the above, except in the case of a demonstrable event where Trafico has had liability, where it will only be liable for the total value of the individual service affected, subtracting the proportional part used in time value.
7. Intellectual Property
Trafico does not in any way grant any license or ownership of the intellectual property used by it. The Client is prohibited from using third-party intellectual property material for which it does not have a license. In the event of detecting a proven unauthorized use, the service may be suspended and cancelled in the event of a repeat offense, without the right to a refund.
8. Service Activation
The service will be activated immediately upon processing payment through Flutterwave, PayPal or Credit Card, however the maximum waiting period for the hosting service to be functional is 48 business hours. For Mobil money payments in Africa, the activation period is 48 business hours.
9. Preinstalled Applications
Among the hosting services there is a tool to facilitate the installation of functional applications for web pages. This service is free of charge so its functionality is not guaranteed. This service is offered by an external provider.
10. Control Panel
All Hosting plans are configured by default with cPanel control panel. Only VPS and Dedicated servers also include WHM to manage the cPanel control panel. The operating system of the services is either AlmaLinux OS, or CloudLinux over AlmaLinux OS or CentOS.
11. Data Migration
When the Customer requires it, he/she may request assistance to migrate his/her Hosting services to us, which will have both technical and operational limitations.
Assistance in the migration can only be provided when it involves the same Control Panel (cPanel). If it is different, the Customer will be responsible for performing his/her information backup and migration manually.
12. Coexistence
Anything not mentioned herein shall be deemed to be covered by the General Terms and Conditions or any applicable specific terms.
