General Terms & Conditions

1. General Information

This document sets forth the General Terms and Conditions offered by Trafico International hosting Networks  (hereinafter “Trafico”) to any individual or entity purchasing services (hereinafter “Customer”). Acceptance of these terms is automatic upon commencement of the service relationship.

For all relevant purposes, Trafico declares itself to be a duly incorporated legal entity, operating in accordance with the laws of the jurisdictions in which it is established. Trafico maintains registered offices and operations in various regions globally, including but not limited to Africa, Asia, Europe, and the Americas and holds all necessary registrations and licenses as required by local laws.

Trafico’s official websites include, but are not limited to, traficohosting.com, trafico.ai, trafico.africa, and trafico.cloud. Trafico also holds registered trademarks for “Trafico,” “Trafico AI,” “Trafico Africa,” “Trafico Cloud Hosting,” “Trafico Cloud,” and “Trafico Hosting,” among other variants, in the regions where it operates. By engaging with Trafico’s services, the Customer acknowledges and agrees to be bound by these General Terms and Conditions.


2. Customer Data

The Customer declares to be of legal age and to have sufficient capacity to be bound to comply with the provisions of this document, and also undertakes to provide real identification information and update it if necessary, if the information used is allegedly false, inaccurate, improper or used without the authorization of the owner, shall be liable for the legal responsibility if applicable, this being a cause for termination of the contract by the Customer's responsibility.

3. Definitions

For the purposes hereof, the following definitions shall be taken and their use shall be determined by the simple use of the first capital letter:

3.1 User Account. Electronic means of access that by means of personal identification offers a space where the Client can review the Client Area, it is composed of a prefabricated e-mail and password that the same user creates to provide security of access to the same.

3.2 Client Area. Digital platform where the Customer can control and manage the contracted services, including billing, registrations, cancellations and modifications, as well as communicate with Trafico Cloud Hosting for customer service purposes.

‍3.3 Shopping Cart. Module where the customer collects one or more services in order to know its characteristics before making the purchase, the services added as a whole can be editable until before making the payment.

3.4 Invoicing. Referred to the process of making a Digital Tax Receipt by Internet that fulfills the requirements of the Tax Administration Service.

3.5 Domain Name/Domain. It is an alphanumeric identifier with which one or a set of resources is located on the Internet, that is to say, it is the “translation” to alphanumeric characters of an IP (Internet Protocol) which allows our domain to be identified in order to reach its information in such a way that allows any user of the network to easily locate our server to access its resources such as Web pages or electronic mail without having to remember a series of numbers (IP Address).

3.6 Web Hosting, Web Hosting or Web Hosting. It is understood to be the space leased by the “COMPANY” in an environment that allows to lodge its information to the client.

3.7 ICANN. The Internet Corporation for Assigned Names and Numbers (ICANN). It is a non-profit, public benefit corporation that operates on a multinational/international level and is responsible for assigning IP protocol addresses, protocol identifiers, domain system management functions, and administration of the root server system.

3.8 WIPO. “World Intellectual Property Organization (in Spanish known as “OMPI” “Organización Mundial de la Propiedad Intelectual”). It is a specialized agency of the United Nations System, dedicated to promoting the use and protection of works of human intellect.

3.9 Registry/Registry. That entity regulated by ICANN itself that the latter grants it the power to manage a specific domain extension, provided that it is demonstrably operational to perform its functions. Broadly speaking, it is in charge of keeping and disposing of all the information related to the domain extension it manages, an example of a registry is Verisign, which is in charge of the “.com” domain extension.

3.10 Registrar. It is an intermediary that helps to connect the registry with the registrant or owner of the domain, as its name says, it is in charge of being the registrar of the domain that the registrant wants to obtain, as long as it is available. An example of Registrant is any company who has the authority and offers domain registration services in its web page.

3.11 Registrant. The owner or holder of the domain, before any authority is responsible for the ownership of the registry and its content, the information of this one appears in the databases of information of property of a domain and its extension.


4. Object

By means of this document, the Customer acquires one or more services that Trafico offers, through its official website, the Client Area or by any means that the Customer and Trafico AI have authorized, in exchange for a quantifiable economic remuneration. The services offered are listed below:

  • Web Hosting.

  • Cloud Hosting Dedicated Servers.

  • Cloud Hosting Virtualized Servers (VPS).

  • Domains.

  • Domain Registration.

  • Information protection (whois).

  • SSL Certificate.

  • DNS Customization.

Each service has its own terms and conditions of use and general description, including additional services that will be named in the terms and conditions of the main product, each service has a separate cost, the final price is determined until before proceeding with the payment in the shopping cart. At the same time the Customer must respect the limits of its service, which are indicated in a Fair Use Policy.

The Customer's consent will be taken through electronic acceptance mechanisms, in addition to requiring a means of payment, at the time of making the monetary transaction will be taken as consensual purchase and therefore this binding document and its annexes.


5. User Account Registration

Before finalizing the purchase of a service, it is the Customer's obligation to create a User Account within the official website; the Customer's information is protected by security certificates and other means of information protection. The Customer's account information will be treated in accordance with the Privacy Notice that Trafico AI has published on its official website. The Client's personal data may be collected by ICANN and its authorized persons, this being an international organization in charge of the correct functioning of the domains, the user accepts that the information be shared with the aforementioned, always respecting its confidentiality, to know its operation. You can consult the document “Rights and Responsibilities of Registrants Under the Registrar Accreditation Agreement” on the ICANN website. It is the full responsibility and importance of the Client to safeguard the information that gives access to their Client Area, since their personal information is located there, as well as the safeguarding of emails and credentials that may arise from their purchased services.

6. Purchase

To proceed with the acquisition of the services that Trafico offers, the Customer must add the services to their Shopping Cart, create a User Account and in turn make the payment through the different means that Trafico offers, through the Shopping Cart. Purchase is editable as long as the monetary transaction has not been made. Having purchased the services, the Client may manage them through their Customer Area, which can be accessed with the email address and password that they themselves have provided.

7. General Restrictions

The Customer is prohibited within and outside of its services and will be subject to termination for its responsibility in the following cases:

Any illegal or illegal material and its derivatives, or that by its publication may legally harm Trafico and its collaborators.

Threatening, abusive, malicious, obscene, blasphemous material against a third party or Trafico, provided that it does not harm the right of free expression of the person who publishes it and at the same time adapts to the criteria of the judge on digital behaviour.

Material that contains viruses or computer programs that attempt to intrusively access the services of Trafico and its other Customers.

Any incitement to regulatory violation, apology for crime and violations of intellectual property rights.

In the event that due to the Client's conduct, Trafico is held responsible for violating any general or special law, or if applicable, sued for acts or omissions that the Client itself performs through our services, the Customer itself shall be liable and hold Trafico AI harmless for all that is accused of it, and shall also remedy any damages and losses suffered by Trafico, including repairing damages to its employees and partners.

The Customer's services may be monitored to identify threats. If any irregular behaviour is detected, Trafico may suspend the Customer's services without prior notice to safeguard the servers. Likewise, if the problem persists, the Customer may be temporarily or permanently suspended, and may be subject to cancellation of the service, whether or not the action or omission made by the Customer is intentional.


8. Notifications

Trafico may send relevant notifications regarding the Customer's service through the email provided, the Customer Area and any other means that the Customer has authorized, provided that Trafico AI consents and approves it.

The notifications include, but are not limited to, service modifications, terms and conditions, renewals, expiration and in general everything that is relevant to the Customer. If the Customer does not object to them, they will be considered as consented to within a period of 15 calendar days after having been notified.

If the Customer wishes to send notifications to Trafico, they may do so through a Ticket in their Customer Area.

9. Jurisdiction

Any disputes arising from the relationship will be previously mediated by the parties. If the Customer is not satisfied, he or she has the right to carry out the procedures granted by the local law. In everything not related to the above, the Client and Trafico adhere to the Jurisdiction and Courts of each local operating region.

10. Customer & Technical Support

The customer support system is set to a defined schedule from Monday to Friday from 09:00 to 18:00 CET, the chat support system is set to a defined schedule from Monday to Friday from 09:00 to 19:00 CET and the ticket system will have a defined schedule from 09:00 to 18:00 CET.

11. License

Trafico in no way grants a license, assignment and/or any other variation on the registered and non-registerable intellectual property that is its property or has permission, in the event of irregular use of intellectual property of Trafico or a third party being detected, the Client will be subject to suspension and/or cancellation of his/her account, in addition to contractual termination due to his/her responsibility.

12. Payments

The type of payment for the services will always be pre-paid or payment before the service is offered, it must cover the rates published on the official website, the price will be marked in US Dollars (USD). Taxes will be published in the Shopping Cart before making the payment for tax reasons. Trafico reserves the right to change prices without prior notice, as long as it is clarified in the Customer's Shopping Cart before paying.

In the event that the payment covers more than the amount contracted, the remainder will remain as a balance in favor of the Customer and may be reimbursed by the Customer's request through the means of notification, this refund has a term of up to 90 calendar days.

The authorized payment methods are:

1.- Paypal.

2.- Momo

3.- Flutterwave

4.- Stripe (Credit/Debit Card)

In the event of any problem in payment processing, an investigation will be initiated to verify whether the error corresponds to our systems or to the payment system, so additional information and/or documentation may be required in order to resolve the problem.

All payments are protected by encryption with international protection standards (PCI DSS in PayPal), and the use of SSL certificates on the website that guarantee coverage in case of damages.

13. Invoicing

The Client has the right to request their invoice through a support ticket. In order for it to be stamped, it must be within the current month in which the purchase was made.

For any modification to the electronic invoice, the Customer may use the customer service channels; this does not guarantee that the modification will be approved by the administration department.

15. Warranty

In the case of the Hosting service plans, Trafico offers a usability guarantee, including the impossibility of activating the service, which can be redeemed in the first 15 days after making the payment, applying only in justifiable cases that arise from a problem of operation, according to what is stipulated/offered by Trafico, the problem will have to be real, verifiable and attributable to Trafico, this guarantee is limited to a refund of a percentage not greater than 80% of the cost of the individual plan less administrative expenses and not counting taxes, for the guarantee to be valid it must be notified in accordance with the “Notifications” clause of this document within the term of the 15 days offered for the guarantee. The guarantee does not apply to service renewals or any other service.

Trafico does not guarantee its clients a service level agreement or percentage of operation, however it will take the necessary steps to remedy any loss of functionality of the service offered to the Customer.

16. Compensation

In the event that Trafico is required, sued or legally prosecuted as a company or its collaborators and partners due to the illegal or improper use of the services by the Customer, the latter is obliged to hold harmless and indemnify Trafico AI for the monetary amount proportional to the damage caused, including collaborators, affiliates, partners and/or its employees, said amount must be paid, at the time that an authority forces us to do so, by way of example, but not limited to, a fine, sentence, execution procedure, prohibition, limitation, exclusion and their relatives.

17. Termination

Natural termination occurs when the Customer does not renew their service and the contracted period expires. To avoid service interruptions, the Customer must renew and make payment before the termination date. If the Customer chooses to terminate their service early, no refund will be issued.

Ninety (90) days after service termination, Trafico may permanently delete all content associated with the contracted service and the User Account, without incurring any liability. In cases where termination results from a violation of Trafico policies or applicable local laws, Trafico reserves the right to delete all content immediately to prevent any legal or reputational risk.

Trafico reserves the right not to renew, to suspend, or to cancel Services for Customers who engage in activities that violate laws, international treaties, or in general, any acts that harm the integrity of individuals or living beings. This includes, but is not limited to, threats, insults, defamation, coercion, incitement to violence, discrimination, and/or racism against anyone, including Trafico staff or affiliates. In such cases, no refund will be provided.

The Customer has the right to respond within three (3) days of receiving notification from Trafico. If no response is received within this period, Trafico will proceed with the action as notified.

19. Consent to Changes

When Trafico makes changes to its terms and conditions, pricing, or any aspect that affects the service, the Customer has the right to reject such changes within three (3) calendar days of notification. In this case, Trafico will work with the Customer to find a solution, which may include termination of services with any applicable guarantees or an adaptation to the previously agreed terms.
