Domains Terms & Conditions

This document establishes the Terms and Conditions for the Domain Name registration service provided by Trafico (hereinafter “Trafico”) to the purchaser of services (hereinafter “Customer”). By contracting this service, the Customer agrees to these Terms and Conditions.

The General Terms and Conditions, which broadly govern the relationship between Trafico and the Customer, as well as specific Policies regulating conduct and service limitations, are available on Trafico’s official website.

Definitions and general information about Trafico are set forth in the General Terms and Conditions.

1. Purpose

The purpose of this document is to define the rights and obligations of the Customer and Trafico when registering, transferring, and generally managing the Domains that the Customer acquires or transfers with Trafico.

2. Characteristics

Domains have as their main characteristic the fact that they are recognized as intangible assets that can be registered and protected by world organizations. Domain registration generates a service charge that the Customer may pay directly to Trafico, the latter acting as Registrar in cases where it has the position conferred.

Your registration is in good faith, so the ownership, contact, administrative and technical data that the Customer enters for registration will be considered correct. If they are investigated and considered fraudulent, false or inaccurate, the registration may be suspended and cancelled.

3. Modifications

Domain prices are mostly modified by the Registry, so the prices offered may be modified at any time. In the event of changes in the administration of the Domain, the Customer must consent to the changes with acceptance mechanisms and will be notified to the owner's email address. Domains are not refundable due to their administration nature. Adding a Domain to the Shopping Cart does not guarantee its availability at the time of payment, it is subject to the Registry's availability.

4. Forbidden Uses

In addition to the prohibitions indicated in the Hosting Terms and Conditions, the Client will also be prohibited from:

Crippling intellectual property rights by registering, transferring and generally managing Domains that are confusingly similar to rights previously reserved by a third party.

Registering Domains that by their name may be considered to go against the Internet ecosystem, for being considered defamatory, obscene, or insulting, provided that the Client's right to free expression is not violated and in turn they do not violate African, Mexican, American and/or European laws, theses or jurisprudence.

Trafico Cloud Hosting reserves the right to report any action considered to be presumptively criminal or against the law.

5. Fair Use Policy

Technical limitations and prohibitions will be indicated in the Fair Use Policy. Failure to comply with the requirements of Trafico may result in suspension of service and cancellation of service in cases of repeat offence, without the right to a refund.

6. Availability

If the Client has his Domain with Trafico and the hosting with another provider, the functionality of the website and its content cannot be reviewed, and the Client's additional services could be affected by the heterogeneity of its services.

Adding your Domain to the Shopping Cart does not guarantee its availability at the time of payment, it is subject to the Registry's availability. It will be the Client's responsibility to check if his Domain has technical, configuration or legal problems that prohibit him from using the administration of his domain in his favor.

It is the Client's duty to verify the expiration of the Domain registration, he will not be able to blame Trafico for lack of expertise for not renewing in time the Domain that the Client has had as owner and that has been registered by a third party, as long as Trafico complies with the pertinent notifications of expiration notice, for which the Client must provide a reliable email.

7. Intellectual Property

Trafico does not in any way grant any license or ownership of the intellectual property used by it. The Client is prohibited from using third-party intellectual property material for which it does not have a license. In the event of detecting a proven unauthorized use, the service may be suspended and cancelled in the event of a repeat offense, without the right to a refund.

If the Client or a third party detects a misuse of their intellectual property rights, and the alleged infringer has services with Trafico Africa, an investigation may be carried out to manage the defense of the rights of the legal intellectual owner.

8. Service Activation

Domain registration will be immediate upon processing payment through Flutterwave, Paypal or Credit/Debit Card, however the maximum waiting period for the Domain to be registered is 48 business hours. If the payment method is Momo, it could take up to 48 business hours for the validation process to be completed and after that, the 48 business hours for the Domain registration to be carried out will follow. If the registration is not completed due to administrative issues, the refund will be made to the Customer's payment account, or to the one indicated by the Customer depending on the case and payment method.

If required, Trafico may also request additional information when dealing with Domain Names that require it, including but not limited to government Domains, from countries whose registration requirements are extended, those related to education, non-profit organizations, among others.

9. Hosting Plans and Domains

In cases where the Client purchases a Hosting plan and it includes the registration of a Domain Name free of charge, as it is a free add-on, there will be no refund or guarantee, nor will it exempt the Client from paying for the renewal of the registration. The promotion will not apply to Domains that must be renewed or for expired Domain transfers, as well as those Domains that are not .com

The free Domain registration must be used as the main Domain of the User Account and must be requested in the original purchase order for it to remain free of charge.

10. Premium Domains

The Domains offered by Trafico on its official website, through its availability search engine, will be considered a simple reference query and its registration with the offered price is not guaranteed until the time of processing the payment. In the event that it cannot be registered, Trafico may offer the Customer a refund for the failed registration of their Domain.

There are also Domains that due to their common nature or the demand they may have due to the easy combination of their characters, may be considered "premium", this will cause the value of the same to fluctuate inadvertently, so in the event of this assumption, the Client accepts the price changes for the registration of the Domain, letting him know that these depend completely on the Registry and not on Trafico.

11. ICANN

Domain Name administration is in charge of ICANN, known in Spanish as the Internet Corporation for Assigned Names and Numbers, therefore the Customer, Trafico and third parties involved are bound by its procedures, criteria and recommendations. It is the obligation of those involved to inform themselves in order to know their rights and obligations, as well as to know the updates regarding processes and everything related to their registration.

The Client, Trafico Cloud Hosting and interested third parties are bound by the procedures and laws that the World Intellectual Property Organization (WIPO) carries out regarding rights and ownership of the Domains.

14. Expiration and Renewal

The Domain ceases to be the property of the Customer on the same day marked as the expiration date in their Client Area, except for those Domains that have special regulations for renewal, and about which information will be sought as far as possible to proceed with the renewal.

When the Domain registration expires, it remains in the public domain and may be purchased, transferred or deleted, however the Client may renew it within a maximum period of 3 calendar days from its expiration date as long as it has not been acquired by a third party. If 5 days or more have passed since the expiration period, the Client will pay a surcharge of 19 dollars (USD) for administrative expenses in case of wanting to renew his expired Domain, if 10 days or more have passed since the expiration period, the renewal surcharge will be 129 dollars (USD), if 15 days or more have passed since the expiration period, the Domain will be out of the reach of Trafico Cloud Hosting to be able to renew it and will not be recoverable. In case of not renewing within 15 days, the domain will be blocked for 90 to 120 calendar days, after the previous period has elapsed, the Domain is released for public registration, with which the domain can be acquired again, however, there is a possibility that the Domain is acquired by a third party, a situation in which Trafico Africa cannot intervene.

15. Add-on ID Protection Service

In the event that the Customer registers his Domain with Trafico, he may acquire the identity protection service that allows the personal data of the Domain that are published in public registries by obligation to be protected by a third party that, in the event of being required by law, may publish them. This service will have its price published on the official website during the offered period. The service will be refundable only in the event that Trafico AI cannot offer it due to its own responsibility. In the event that the Customer has acquired it in a domain not registered with Trafico AI, no type of refund will apply. The service only applies to Domains that the Customer has registered with Trafico AI, excluding regional domains and their derivatives.

16. External DNS and Custom DNS

The external DNS service allows you to customize the communication between the page and the Internet server, thus allowing for better connectivity and communication

The custom DNS service allows the Customer to choose for their domain to appear as a provider instead of the generic Nameservers that Trafico uses with all other clients, this allows the Customer to customize their image directed to the Internet ecosystem, this service has a fixed price without taxes published on the site trafico.africa/custom-dns, from which the Customer may add the service, there are no refunds or guarantees and the usability will directly depend on the Customer correctly adding the Domain, whether external or registered with Trafico AI.

17. DNS Management

The DNS Change service (DNS Manager) is a related service that requires ownership of a Domain with Trafico. This service is used to manage and consult the DNS records to improve its operation depending on the use that the Client is going to give it (emails, redirection, etc.). The service can be contracted in the shopping cart when registering a domain or in the Client Area when managing the additional services of the domain.

Trafico is not responsible for the administration that the Customers gives to his domain, so the Customers must have prior knowledge of the actions carried out to avoid incorrect use of it.

18. Domain Management

The Domain Management service has the function of forwarding emails from a domain that belongs to you to another different email address, so that they can be viewed in both email addresses. The service has a fixed cost, not including taxes, and will not have any guarantee except for the responsibilities attributed entirely to Trafico.

19. SSL Certificates

The SSL (Secure Socket Layer) Certificates service allows secure connections between the server and the browser, enabling the encryption of information so that the end user of the website is certain of the veracity of the site and the protection of sensitive information, the SSL Certificates service of Trafico Cloud Hosting can be offered in the domains that the Client has contracted directly or that it owns with an external provider, the offered price will be published on its specific page trafico.africa/ssl-certificates in different plans however it may change until before the acceptance of payment, the service is provided by a third party security specialist who economically guarantees in case of a loss due to negligence of the issuance and control of the SSL Certificate, there are no guarantees or returns in this type of services except for not being able to provide the service due to the responsibility of Trafico Cloud Hosting.

20. Coexistence

Anything not mentioned herein shall be deemed to be covered by the General Terms and Conditions or any applicable specific terms.
